2012 DO MORE Contest Rules (the “Rules”)

1. CONTEST DURATION:  The WIN MORE STUFF Contest (“Contest“) is being held by Aspire Nutrition Inc. (“Aspire“) and Personal Best Health & Performance (“PB”).  The Contest starts at 12:00:01 am Eastern Standard Time (“ET”) on March 9, 2012 and ends at 11:59:59 p.m. ET on April 30, 2012 (“Contest Period”). 

 

2. ELIGIBILITY:  The Contest is open to all legal residents ofCanada who are of the age of majority in their Province of residence at the time of entry into the Contest.  Employees, agents and representatives of Aspire or PB and their subsidiaries and affiliates or their advertising and promotion agencies, are not eligible to win the Contest, nor is any person with whom any such employee, agent or representative is domiciled.  PLEASE DO NOT ENTER THE CONTEST IF YOU ARE INADMISSIBLE.  Entrants must have a valid passport in order to be eligible to win the Gold Medal Prize.

 

3. HOW TO PARTICIPATE:  Each eligible person who accesses the Contest landing pages at either the 7SYSTEMS or PB websites (“Contest Pages“) registers, submits and approves an online entry to the Contest or fills out a hard copy of the Contest entry form (“Entry Form”) manually and provides to Aspire or Infinit (“Entrant”) shall be entered.  There is a limit of one (1) Contest submission per person.  The Contest Pages shall be available at www.7systems/contest.ca.

 

Aspire and PB reserve the right, at their option, to decline any Entrant that submits offensive or inappropriate material with its entry.

 

4. PRIZES:  There are three (3) prize packages (each a “Prize”, collectively the “Prizes“) available to be won, as follows:

 

Gold Medalist (1 prize to be awarded)

 

(a) One paid entry fee in respect of the 2012 Escape From Alcatraz triathlon (the “Race”);

(b) coaching support from PB in respect of the Race; and

(c) a one (1) month supply of 7SYSTEMS Endurance Sports Supplement.

 

Approximate retail value of this Prize is two-thousand Canadian dollars ($2000 CDN).

 

Conditions on Gold Medal Prize

 

(i) All other costs not specifically stated as being part of the Gold Medal Prize will be at the sole expense of the winner.  These include, but are not limited to, the cost of transportation to and from the location of the Race, baggage or other airline related charges, accommodation, meals and drinks, gratuities, taxes, insurance and items of a personal nature;

(ii) Gold Medal Prize winner is responsible for ensuring that he/she has any and all required travel documentation and that such documentation is valid prior to and for the entire duration of the trip;

(iii) if the Gold Medal Prize winner decides not to do the Race, no credit or reimbursement will be awarded;

(iv) neither Aspire nor PB shall bear no responsibility for Race delays or cancellations or if Entrant is unable to participate in the Race due to injury, illness, lack of fitness or otherwise;

(v) any advice given by coaches at PB is provided solely by PB and not by Aspire; and

(vi) Aspire and PB reserve the right, in their sole discretion, to substitute the prize or any portion thereof for another prize of equal or greater value, or its monetary equivalent.

 

Silver Medalist (1 prize to be awarded)

 

(a) A one (1) month supply of 7SYSTEMS Endurance Sports Supplement;

(b) one set ofRydersunglasses;

(c) one Mountain Hardwear Fluid 26 backpack;

(d) one pair of Aquasphere swim fins; and

(e) one pair of Aquasphere Cayenne swim goggles.

 

Approximate retail value of this Prize is one-thousand Canadian dollars ($1000 CDN).

 

Bronze Medalist (1 prize to be awarded)

 

(a) A one (1) month supply of 7SYSTEMS Endurance Sports Supplement;

(b) a one (1) hour coaching phone consultation with coaches at PB; and

(c) triathlon training dvds.

 

Approximate retail value of this Prize is three-hundred Canadian dollars ($300 CDN).

 

5.  PRIZE AWARDING:  Aspire will hold a random drawing at Aspire’s offices inToronto,Ontario at approximately 9:00 pm on May 6th to select Entrants to be eligible to win the Prizes.  The first Entrant whose entry is drawn in the random drawing and who otherwise complies with these Rules will be eligible to win the Bronze Medalist Prize, the second Entrant whose entry is drawn in the random drawing and who otherwise complies with these Rules will be eligible to win the Silver Medalist Prize and the third Entrant whose entry is drawn in the random drawing and who otherwise complies with these Rules will be eligible to win the Gold Medalist Prize .  Odds of winning will depend on the number of eligible entries received during the Contest Period. 

 

Aspire will make reasonable attempts to contact the selected winners by e-mail within five (5) business days after the drawing.  To be confirmed as a winner and claim the applicable prize, the selected Entrant must: (i) correctly answer, unaided, a time-limited mathematical skill-testing question administered by Aspire; (ii) complete, sign and return a release form, including a publicity release, within five (5) business days of the date he or she was contacted by Aspire; (iii) supply any and all information reasonably required by Aspire to administer the Contest and award the prize; and (iv) otherwise comply with these Rules. 

 

If a selected winning Entrant (a) cannot be reached within five (5) business days, (b) does not complete, sign and return the release form within five (5) business days of being contacted, (c) does not correctly answer the mathematical skill-testing question in the manner described, (d) is not eligible to be an Entrant, (e) refuses his/her Prize, (f) does not supply any required information or documents within the period specified, or (f) does not otherwise comply with these Rules, he/she will be disqualified and will not win the applicable Prize. In that event, an alternate potential winner may be selected in accordance with these Rules or the prize may be annulled, in Aspire sole discretion.  Prizes will be delivered to the confirmed winning Entrants only.

 

A Prize must be accepted as granted and cannot be converted to cash.  A Prize cannot be exchanged for another Prize except at the sole discretion of Aspire. A Prize cannot be sold or transferred to any other person.  Refusal to accept a Prize absolves Aspire of any and all obligations relative to said Prize and any and all obligations towards the selected Entrant.

 

6. CONTEST GENERAL RULES:  By entering the Contest, Entrants agree to abide by these Rules and any subsequent amendments thereto made by Aspire and the decisions of Aspire, which are final, binding and irrevocable in all aspects relating to the Contest.  Neither Aspire nor PB will be responsible for late, lost, invalid, illegible, delayed, incomplete, stolen, or misdirected entries/prize claims.  All entries/prize claims become the property of Aspire and PB, and will not be returned.  Neither Aspire nor PB shall in any way bear any liability whatsoever regarding any of the Prizes.

 

Each Entrant, by entering the Contest, gives permission to Aspire and PB, at their option, to publish or otherwise use and edit the Entrant’s name, address, photograph, image, voice, comments and any declaration relative to the Contest, without compensation, remuneration or reparation, in any and all publicity carried out by Aspire or PB or any of their advertising agencies.

 

If the identity of an Entrant is disputed, the authorized account holder of the email address submitted at the time of entry will be deemed to be the Entrant.  For the purpose of these Rules, “authorized account holder” of an email address is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

 

Neither Aspire nor PB shall be held responsible for any error or omission related to the printing or advertising of this Contest.

 

Aspire, PB and their affiliates, administrators, partners, directors, employees, agents and representatives (the “Released Parties”) shall not be held liable for defective functioning of any computer hardware or software, lines of communication, or network communications related to the loss or absence of network communications or any other defective, incomplete, incomprehensible or erased transmission via any computer, network or server that could limit or render impossible the capacity for any person to participate in the Contest.  The Released Parties assume no responsibility or liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies or any release.

 

The Released Parties are hereby totally absolved of any responsibility for any damage or loss that could be directly or indirectly caused in part or in whole by uploading or downloading any software or information including the transmission of any information related to participating in the Contest.

 

By participating in this Contest, attempting to do so, or accepting a Prize, all Entrants agree to release and hold harmless the Released Parties from any and all liability, including without limitation, for any loss, harm, damage, injury, cost or expense, personal injury and/or death, which may occur in connection with participant’s participation in the Contest, or possession, acceptance, participation and/or use or misuse of a Prize, however arising, including Released Parties negligence, and for any claims based on publicity rights, defamation or invasion of privacy.  Neither Aspire nor PB is responsible if Contest cannot take place or if a Prize cannot be awarded due to reasons outside of Aspire or PB’s control including acts of war, natural disasters, weather, acts of terrorism or labour strikes. Neither Aspire nor PB is responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, or other error of any kind whether human, mechanical or electronic.

 

Subject to the jurisdiction of the Régie des alcools des courses et des jeux in Quebec, Aspire and PB reserve the right to nullify, end, modify or suspend this Contest for any reason including in the event of a virus, computer bug, unauthorised human intervention or any other cause out of its control that could corrupt or affect the administration, safety, and impartiality or smooth running of the Contest.

 

All Entrants hereby agree not to deliberately interrupt or corrupt the smooth running of the Contest, not to stop other people from participating in the Contest, and not to interfere with the legitimate running of the Contest, including, but not limited to submitting multiple entries for the same person using multiple email addresses. Furthermore, Entrants agree not to, in any way, act contrary to the Rules with the understanding that any such act shall result in automatic disqualification of the participant and that he or she may be prosecuted under the full force of the law at Aspire’s discretion.

 

The use or reproduction of any copyright material or trademark related to this Contest is strictly prohibited, except with the prior express written consent of the rights holder.

 

In the event that an authority with jurisdiction declares any portion of these Rules invalid, illegal or unenforceable, said judgement shall not in any way affect any other aspect of these Rules, which shall remain valid and in effect.

 

7. DISQUALIFICATION:    Persons found tampering with or abusing any aspect of this Contest, as determined by Aspire will be disqualified.  Any false declaration by an Entrant, or failure to comply with these Rules will result in automatic disqualification of the Entrant and forfeiture of any Prize.

 

8. EXPENSE:  Any expenses incurred in taking part in the Contest are the sole responsibility of the Entrants.

 

9. PRIVACY:  By entering this Contest, you consent to the collection, use and sharing of information about you by Aspire and PB for the purpose of administering this Contest and any marketing purposes of Aspire and PB and their affiliates.

 

10. QUEBEC RESIDENTS:  Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling.  Any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping parties reach a settlement.

 

11. REST OF CANADA:  For residents of all other Provinces/Territories outsideQuebec, any litigation must be commenced in the City of Toronto, Ontario.

 

12. APPLICABLE LAWS:  This Contest is subject to all applicable federal, provincial and municipal laws inCanada.

 

13. RACE REPORT.  The Gold Medalist shall submit a type written report to Aspire and PB in respect of their participation at the Race within 2 weeks of the date of the Race.
